Definitions
“Customer” refers to the person, firm, company to whom a Candidate is introduced through the Wecruiters.com website. Any entity having links to the Customer are also considered as Customers.
“Candidate” refers to the person introduced to Customer through the Wecruiters.com, including but not limited to, any member of the Candidate if the Candidate is a company.
“Supplier” refers to Wecruiters.com.
“Member” refers to any person or company registered on Wecruiters.com.
“Visitor” any person or company visiting the Wecruiters.com directly or through any other means.
Article 1. Applies for all members and visitors. The present Terms and Conditions supersede all other terms and conditions in the event of a conflict. All vacancies submitted by the Customer shall be governed by the current Terms and Conditions.
Article 2. Fees.
Fees are based on a standard fee of three thousand euros and shall be payed by the Customer to the Supplier if the Customer decides to hire the proposed Candidate or collaborate with the Candidate. VAT and other taxes are not included in the fees and shall be added to the fees if applicable.
Article 3. Payment conditions. Customer shall pay Supplier's fees mentioned in article 2. Payment term is 30 days after the invoice date. All invoices that remain unpaid after the payment term, will be subjected to a compensation of 10% with a minimum amount of hundred euros based on an annual interest of 10%.
Article 4. Collaboration.
4.1 If the Customer does not hire the Candidate or if Candidate rejects after all the employment or conditions offered by the Customer, and if eventually the Candidate is hired or collaborates with the Customer within a period of eighteen months following the date of the first introduction of the Candidate to the Customer, then the Customer shall pay fees to Supplier as mentioned in the above article 2.1.
4.2 If the Customer introduces the Candidate to any other party and if the Candidate is hired by that said party or collaborates with, then the Customer shall pay the fees as mentioned in article 2.1.
4.3 If for a given vacancy and any given reason the Customer hires or collaborate with more than one of the introduced Candidates, instead of just the one as contractually agreed upon, then the Customer shall pay Supplier fees for each of the Candidate hired, as mentioned in the above article 2.1.
4.4 The Customer shall inform Supplier of the hiring of any Candidate(s) within 7 calendar days, this communication must include the terms and conditions of the employment contract agreed to by the Candidate(s) hired.
4.5 For each submitted vacancy all members agree not to collaborate outside the Wecruiters.com platform thus bypassing the Supplier.
Article 5. Responsibilities.
5.1 All Candidate's possible expenses related to interview, transport, work permit and authorizations are for the Customer's account.
5.2 If the Customer or the Candidate cancels the employment contract during the first three months from the signing date of the employment, the Supplier will use its best efforts to find a replacement without any additional cost for the Customer, under the strict conditions that:
a) all amounts due by the Customer have been paid on time and that job description has not changed,
b) the Customer has notified Supplier in writing within seven days of termination that employment has been terminated,
c) the Customer or one of its subsidiaries or an other company of the group has not hired the Candidate within a period of 18 months following the end of the contract.
d) the end of the contract is not a result of an economic lay-off or from a modification of the position exercised by the Candidate or from a restructuring by the Customer.
5.3 Supplier will use its best efforts to ensure the skills and the aptitude of the Candidates to maintain a high quality of service and integrity, but does not guarantee this expressively nor implicitly.
5.4 Supplier is not responsible in anyway to the Customer for any damage, loss, expenses, or spending’s suffered or incurred by the Customer in connection with the hiring of Candidates by the Customer.
5.5 It is the Supplier's aim to make the Wecruiters.com platform accessible to its members at all times and without interruptions or malfunctions but the Supplier does not explicitly guarantee this and cannot be held responsible for any interruption and errors on the Wecruiters.com platform.
Article 6. Legal / Anti-corruption.
6.1 All members agree to resolve any unlikely legal dispute in the courts of Brussels using Belgian and International laws.
6.2 All members all agree to swiftly inform in writing the Supplier details of any bribe request, demand or offer. This is an ongoing obligation.
6.3 All members and visitors agree that all content that includes personal data, are subject to our Privacy Policy. They also commit to only provide information and content that is truthful and over which they have right to share.
6.4 All members commit not to use others’ information or content and that if they do, it is at their own risk.
6.5 All information and data provided by members belong to the provider of the information or data and they grant Supplier a so called non-exclusive, royalty-free license on it to use, reproduce, store, publish, adapt, translate and distribute your content in any existing or future media.
6.6 Supplier may change, end and modify this contract and any services and it’s prices prospectively. When there are changes, all members shall be informed by Supplier. If members disagree, they may stop using Supplier services and close their account.
6.7 All members acknowledge that Supplier cannot be held responsible for the behaviour of our members either on or off our website.
